Terms of Service

These Terms of Service ("Terms") govern your access to and use of Gluten Free Caterers (the "Directory"), operated by CKKC Associates LLC ("we", "us", "our"). By using the Directory, claiming a listing, or purchasing a Featured Listing, you agree to these Terms. If you do not agree, do not use the Directory.
1. Who these Terms apply to
- Visitors browsing the Directory.
- Listing Owners — people who claim and manage a business listing.
- Purchasers — Listing Owners who buy a paid placement.
If you accept these Terms on behalf of a business, you represent that you are authorised to bind that business.
2. Listings and claiming
Listings are compiled from public sources and may be incomplete or out of date. A listing does not imply any relationship between us and the business.
To claim a listing you must register an account, verify your email address, and submit a claim for our review. We approve claims at our discretion and may require evidence that you are authorised to represent the business. Approval grants you the ability to edit certain listing fields; it does not transfer ownership of the listing itself, which remains part of the Directory.
We may revoke a claim at any time if we believe it was made without authority or the information provided is inaccurate.
3. Featured Listing
A Featured Listing is a paid, time-limited promotional placement that moves your listing to the top of Directory search results and category pages, and marks it with a "Featured" badge.
What you are buying: placement. You are not buying leads, enquiries, rankings in third-party search engines, traffic volumes, or any commercial outcome. See section 8.
4. Term and activation
A Featured Listing runs for 30 consecutive days, beginning when the placement activates. Activation normally occurs within a few minutes of successful payment. The end date is fixed at activation and is shown on your listing.
Placement is continuous for the term. Brief interruptions caused by maintenance, deployments, or events outside our control do not extend the term, but if placement is materially unavailable for more than 48 consecutive hours we will extend the term by the affected period on request.
5. Fees and payment
The price of a Featured Listing is $199 USD, charged once, at the time of purchase. Prices are exclusive of any applicable taxes, which will be added where required.
Payments are processed by our payment provider. We do not store your full card details. You warrant that you are authorised to use the payment method you provide.
6. No automatic renewal
A Featured Listing does not renew automatically. It is a single, one-time purchase. Your payment method will not be charged again unless you make a new purchase yourself. We may notify you before your placement expires so you can choose whether to buy another term; any such notice is a reminder, not a charge.
7. Refunds and cancellation
You may request a full refund within 7 days of activation for any reason, by contacting us at the address in section 15.
After 7 days the fee is non-refundable, because the placement has been delivered for that period.
A refund ends the placement immediately. Your listing reverts to a standard, unfeatured listing as soon as the refund is processed. You cannot receive a refund and retain the placement.
Nothing in this section limits any refund or cancellation right you may have that cannot be excluded under applicable law.
8. No guarantee of results
We do not guarantee any level of visibility, impressions, clicks, enquiries, bookings, revenue, or search-engine ranking arising from a Featured Listing. Directory traffic varies. Results depend on factors outside our control, including your own listing content, pricing, availability, and competition.
Where the Directory displays counts, positions, or ratings, these are provided for information only and may be estimates.
9. Editorial control and placement
We retain full editorial control over the Directory. Specifically, we may:
- determine the layout, design, and ordering of Featured Listings, including where more than one listing is featured at the same time;
- decline, pause, or remove any listing or Featured Listing that breaches these Terms or that we reasonably consider unlawful, misleading, unsafe, or damaging to the Directory;
- correct obvious errors in listing data.
If we remove a Featured Listing for a breach caused by you, no refund is due. If we remove it for any other reason, we will refund the unused portion of the term on a pro-rata basis.
10. Your content
You retain ownership of the text, images, and other material you submit ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for formatting, and display Your Content in connection with operating and promoting the Directory, for as long as your listing appears.
You warrant that:
- you own Your Content or have all necessary rights and permissions to submit it, including for any photographs and any people shown in them;
- Your Content is accurate and not misleading, including any claims about gluten-free preparation, dedicated facilities, certification, allergen handling, or accreditation;
- Your Content does not infringe anyone's rights and does not contain unlawful, defamatory, discriminatory, or offensive material.
You must not use listing fields for keyword stuffing, promotional slogans in the business name, competitor references, or contact details that redirect users away from the business the listing describes.
Allergen claims carry real risk. If your listing states or implies that food is gluten-free, coeliac-safe, or prepared in a dedicated facility, you are solely responsible for the truth of that statement and for complying with all applicable food-safety and labelling law.
11. Changes to listing information
Certain fields — including the business name, address, and primary image — may require our review before changes take effect, to protect the integrity of the Directory and of accumulated reviews and ratings. We aim to review promptly. Other fields update immediately.
Reviews and ratings belong to the Directory record, not to the Listing Owner, and are not transferred, altered, or removed on claim, purchase, or refund.
12. Acceptable use
You must not misuse the Directory, including by scraping it at scale, interfering with its operation, attempting to gain unauthorised access, submitting false claims, or using it to send unsolicited communications.
13. Disclaimers and limitation of liability
The Directory is provided "as is" and "as available". To the fullest extent permitted by law we exclude all implied warranties.
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with these Terms and the Directory is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for lost profits, lost business, lost data, or indirect or consequential loss.
Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
We are not a party to any transaction between you and a business listed in the Directory. We do not verify the food-safety practices, certifications, insurance, or allergen controls of listed businesses, and we are not responsible for their goods or services.
14. Indemnity
You will indemnify us against any claim, loss, or expense arising from Your Content, from your breach of these Terms, or from goods or services you supply to a customer who found you through the Directory.
15. Suspension and termination
You may close your account at any time. We may suspend or terminate your account or a listing for breach of these Terms, or where required by law. Sections that by their nature should survive termination (including 8, 10, 13, and 14) survive.
16. Privacy
Our handling of personal data is described in our Privacy Policy.
17. Changes to these Terms
We may update these Terms. Where a change materially affects a Featured Listing you have already paid for, the version in force at the time of your purchase continues to apply for that term.
18. Governing law
These Terms are governed by the laws of the State of California, and the state and federal courts located in Sacramento County, California have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you where you live.
